About these terms

These Terms of Service ("Terms") apply to your use of the Menodoctor website and the products and services we provide. "Menodoctor", "we", "us" and "our" refer to Dear Medical Ltd (NZBN 9429050627806), a company registered in New Zealand and trading as Menodoctor, of 6/33 Hairini Street, Hairini, Tauranga 3112, New Zealand. Our website is hosted on Shopify.

By booking a consultation, purchasing a product, or otherwise using our website, you agree to these Terms, our Privacy Policy, our Refund & Cancellation Policy and our Pricing & Fees Policy. If you do not agree, please do not use our services.

Our services and the nature of care

Menodoctor is a private specialist menopause and hormone clinic. Our doctors are registered with the Medical Council of New Zealand and provide care in line with the Council's standards, including its Statement on Telehealth and Good Prescribing Practice.

We provide specialist menopause and hormone care. We are not your general practitioner (GP) and are not connected to the public GP or hospital records systems. We do not provide emergency care. 

If you have a medical emergency, call 111 or contact your nearest emergency department. 

We work alongside your GP and provide them with a summary of your care; ongoing management of medical conditions and medications outside our hormone scope remains with your GP.

Care is provided only where clinically appropriate. Our doctors may decline to provide a consultation, prescription, test or treatment where it would not be safe or appropriate, or where it falls outside our scope of practice. The decision whether to prescribe is a clinical one and rests with the treating doctor.

Telehealth and prescribing

Most of our consultations are provided virtually. By choosing a virtual consultation you accept that care is delivered using video or phone, and that this has some limitations compared with an in-person assessment. Our prescribing follows New Zealand law and Medical Council standards.

If you are physically overseas at the time you receive care or wish to obtain medication, please tell us. Prescriptions we issue are New Zealand prescriptions; we cannot guarantee they will be valid, dispensable, or lawful to carry or import in another country, and you are responsible for complying with the laws of any country you travel to. We may decline to prescribe where doing so would not be appropriate or lawful.

Use of AI tools

We use artificial intelligence (AI) tools to help run our clinic efficiently — for example to assist with administration, scheduling, and drafting and organising communications and documents. These tools support our team and do not replace clinical judgement; all clinical decisions, prescriptions and advice are made and reviewed by our doctors. Booking, eligibility and consent

You must be at least 18 years old to use our services. You agree to provide accurate, current and complete information, including your health information and pre-consultation questionnaire, so that we can provide safe care. Treatment is provided only with your informed consent, in line with the Code of Health and Disability Services Consumers' Rights (see our Know Your Rights page).

Prices, fees and payment

Our fees are set out on our Pricing page and governed by our Pricing & Fees Policy. All prices are in New Zealand dollars and include GST at 15%. Payment is due at the time of booking; bookings held without full payment must be paid no later than 7 days before the appointment. We may correct pricing errors and decline or cancel an order where information is inaccurate.

Cancellations and refunds

Rescheduling, cancellations, missed appointments and refunds are governed by our Refund & Cancellation Policy. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

Your responsibilities

You agree to use our services lawfully and honestly, to keep your account details secure, and not to misuse the website (for example by attempting to interfere with its security, scrape data, or impersonate another person). You must not on-sell or export products purchased for personal use.

Intellectual property

All content on this website — including text, images, video, logos and the Menodoctor name and branding — is owned by Dear Medical Ltd or its licensors and is protected by New Zealand and international intellectual property law. You may view and use the content for your own personal, non-commercial use only. You may not reproduce, republish or distribute it without our written permission.

Disclaimer and limitation of liability

General information on our website (for example educational articles about menopause) is provided for general information only and is not individual medical advice. Always rely on the advice given to you in your own consultation.

To the extent permitted by law, and except for the guarantees that cannot be excluded under the Consumer Guarantees Act 1993, we are not liable for any indirect or consequential loss arising from your use of the website. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded. Where our services are supplied in trade, and you acquire them for business purposes, the Consumer Guarantees Act may not apply.

Third-party services

Our website uses third-party services including Shopify (hosting and checkout) and Stripe (payments). Your use of those services is also subject to their terms. We are not responsible for third-party websites we link to.

Privacy

We collect and handle personal and health information in accordance with the Privacy Act 2020 and the Health Information Privacy Code 2020. See our Privacy Policy.

Changes to these terms

We may update these Terms from time to time. The current version is always available on this page, and your continued use of our services means you accept the updated Terms.

Governing law

These Terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction over any dispute.
